INDIGENOUS PEOPLES MEETING AT THE UNITED NATIONS IN GENEVE: DEMANDING URGENT PROTECTION FOR THE OTOMI TOLTEC CULTURAL HERITAGE AND NATURAL SACRED SITES

Our survival and our future as Otomi Toltec People from Mexico is once again in danger!

Concerned by recent events, we denounce the acts of ethnocide and ecocide, which are being committed right now by the current leaders who exercise in a vicious way neo-colonial power.

The Mexican Government, the establishment, the oligarchic state have imposed us a culture of discrimination, racism, violence, pollution, sicknesses, destruction and extermination. They invade, expropriate and steal our lands through a racist and corrupt legal system, anti democratic, authoritarian and fascist practices. They impose us their death projects such as dams, industrial parks, malls, residential complexes, airports, railways and highways.

Like their political and economic predecessors of colonial groups, they once again put our Otomi Toltec People in a situation which threatens the integrity of our lands our territories and our ethnic and social cohesion. They trample the dignity of our families and communities, they jeopardize our tangible and intangible culture, the ancestral spirituality and our vision of the cosmic world.

This is an emergency call and a complaint against Enrique Peña Nieto (President of Mexico) and Eruviel Ávila Villegas (Governor of the State of Mexico). They seek to impose the construction of highways at all costs under the guise of so “called” legal strategies in an authoritarian and violent way. They violate our human and indigenous rights, they just declare a war to us, killing thousands of trees, destroying the biodiversity in our forests, crashing our houses and polluting our springs. They don’t care to destroy our natural and cultural sacred sites. They commit ecocide and ethnocide against the Otomi Toltec people, affecting communities as Xochicuauhtla.

Their sole purpose is to benefit a monopolistic political and economic mafia, linked to multinationals and corrupt Banks. They protect interests of friends and accomplices of the government, such as Juan Armando Hinojosa Cantú (Entrepreneur, owner of Higa Group, who is also involved in the global scandal of alleged tax evaders in Tax havens of “Panama Papers”).

All of them, have declared to wage a kind of low intensity war, a terrorism inflicted by the government against the Otomi Toltec People. This is a neo-colonial and discriminatory campaign with racist and violent actions, which constitute crimes against humanity.

Last Monday 11 April 2016, the government under the rule of Ávila Villegas and Peña Nieto, invaded the ancestral territory of the Otomi people in the Community of Xochicuauhtla, municipality of Lerma by surprise at 9 AM, destroying our homes and leaving our sacred land devastated. Over 1,000 riot police, assigned by the Secretary of Security for Citizens (SSC) and the Forces of Action and Reaction (FAR), infiltrated the community strategically on three fronts.
The purpose of the police was to protect the heavy machinery bulldozers that came in the community to demolish the homes of the people. They were from the Autovan Constructions of Teya Higa Group, their mandate was to destroy the houses, raping Mother Nature and sweeping away everything in its path, to make place for this private highway project of Juan Rodolfo Cantu Hinojosa.

As an act of solidarity in this emergency, about 25 neighbors banded together to defend the family of Armando Garcia Salazar, one of the leaders of the Otomi Toltec Community. His house was completely raided and with that his whole life sullied. The repressive groups of Eruviel Avila and his boss Enrique Peña came order to evict the Otomi with great violence, mostly women, children and grandmothers. The grenadiers entered the family property by force, smashing the door with pipes and firing tear gas into the houses, kicking, dragging, pushing and pulling our Grand Mother Isabel Hernandez with her little grandchild in her arms. Isabelle is also a traditional authority and member of the Indigenous Supreme Council of Xochicuauhtla.

After this brutal attack on the Otomi Toltec Community on 11 April 2016 destroying our homes, polluting our land and exterminating our people and culture, we demand the immediate intervention of the United Nations and the International Court of Justice in The Hague for Enrique Peña Nieto, President of the Republic of Mexico and Eruviel Avila Villegas, Governor of the State of Mexico.

We demand that they are tried for crimes against humanity and nature, namely ecocide and genocide against the Otomi Toltec People and also for the violation of human rights, the rights of indigenous peoples and rights of nature as it is contained in the International declarations, conventions and agreements.

We demand the immediate intervention of the United Nations Organization and all national and international bodies to stop the police occupation and invasion by the Mexican government against our Otomi Toltec people in the communities such as San Francisco Xochicuauhtla, municipality of Lerma, State of Mexico. To stop this war of extermination, ecocide, genocide and crimes against sacred territories and humanity, which is happening right now. We demand justice! The leaders responsible for these crimes must be judged, they must pay for every abuse of power.
We demand from the Mexican government, the final, immediate and unconditional cancellation of the Decree of Expropriation of 33.5 Hectares in the Sacred Forest of Xochicuauhtla. This was imposed illegally on all the Otomi people, by government of Enrique Peña Nieto and Eruviel Avila Villegas. WE demand the unconditional suspension of the highway toll from Toluca-Naucalpan, in Xochicuauhtla Territory, by the Autovan Constructora Teya of the Higa Group. The immediate, total and unconditional withdrawal of the police force, bulldozers and staff of the company.
We demand the immediate resignation of Enrique Peña Nieto, President of Mexico and Eruviel Ávila. This government of Mexico is directly responsible for ecocide and genocidal war, using state terrorism; applying systematic violence, series of environmental crimes in the Otomi Toltec Territory, for grave violations against Mother Nature, a Human Rights.
We demand the UN, UNESCO, ILO, OAS and the International Community to pressure the Mexican government (executive, legislative and judicial branches of the Federal Government and the Government of the State of Mexico), to fully implement the international conventions and treaties adopted and ratified by the Mexican Government.

e) The National Legislation and COCOPA Law on Indigenous Rights and Cultures of the Commission of Concord and Pacification appouved by the Mexican Congress in 2006.
Most importantly we demand the unconditional respect of all our rights as indigenous people, including the rights to self-determination, sovereignty and independence of our lands and territories, the free management of our environment, housing, social, cultural and spiritual.
We demand the end of this war of this insidious extermination in the name of so-called progress and economic development, the end of terrorism by the Government of Mexico and the State of Mexico, the end of all forms of discrimination, racism and violence against our people.

We appreciate the immediate solidarity with the Otomi Toltec people, to have the respect and be able to fully exercise their inalienable right of self-determination and as an expression of this, the Political, Territorial and Cultural Autonomy. To have the respect for all its historical and collective rights, to defend the integrity of their ancestral lands and territories, to have a harmonious land, healthy environment, water, life and happiness.

We want to live in peace, justice and dignity for all peoples and in perfect harmony with nature.

THE XOCHICUAUTLA CASE AT THE UNITED NATIONS IN GENEVA

SUBJECT: Urgently requesting support against ecocide, the violation of human rights, Indigenous Rights and the destruction of Cultural Heritage.

We are calling to the United Nations and the whole International Community to take urgent actions because of the authoritarism, discrimination and the systematic violation of the Indigenous Peoples Rights by the Mexican Gobenment, for which we are really concerned. I would like to take this opportunity to inform you about a situation on the ground in an Indigenous Community, which endangers the cultural heritage, the identity, the language and the ancient wisdom of the Otomi Toltec People.

This is an emergency call and a complaint against Enrique Peña Nieto (President of Mexico) and Eruviel Ávila Villegas (Governor of the State of Mexico). They are imposing the construction of a railway and a private highway from Toluca to Mexico City (to benefit mainly to Higa Group owned by Juan Armando Hinojosa Cantú), cutting through a huge archeological zone where ancient Pyramids and Temples are buried under the earth which are sacred to the Indigenous Peoples and part of their cultural Heritage. One Pyramid and other sacred temples and basements, have already been destroyed in the Ceremony Center of Dongu between the towns of Lerma and Ocoyoacac. An ancient and sacred forest has also been destroyed and the springs greatly polluted. With unacceptable practices of discrimination, racism, corruption, repression and expropriation the Mexican Government is trying to impose another Private Highway (from Toluca Airport to Mexico City) and committing ecocide and ethnocide in Xochicuauhtla as well.

Also 3 month ago on the 11th of April, the government of Mexico, ordered a forceful invasion of the ancestral territory of the Otomi Toltec people in the Community of Xochicuauhtla. 1,000 police entered homes using teargas, led pipes, kicking and dragging the people evicting the Otomi Toltec People from their homes with great violence. They demolished homes of the indigenous people with bulldozers, leaving the people devastated and without shelter or any compensation.

  1. We demand that the Government stops this massif human rights violation towards the Otomi Toltec People and the environmental.
  2. We demand the immediate intervention of the UN and all national and international bodies to stop the police occupation and invasion by the Mexican government of the Otomi Toltec community of San Francisco Xochicuauhtla and this area of sacred temples pyramids and cultural heritage.
  3. We demand from the Mexican government, the final, immediate and unconditional cancellation of the Decree of Expropriation of 33.5 Hectares of the Sacred Forest of Xochicuauhtla. This was imposed illegally on the Otomi people, by the government, not honoring free-prior and informed consent.
  4. We demand the unconditional suspension of the highway toll from Toluca-Naucalpan, in Xochicuauhtla Territory, (by the Autovan Construction Company from Teya Society of the Higa Group) and the immediate and unconditional withdrawal of the police force, bulldozers and staff of the construction company.
  5. We demand the UN and the International Community to put on their political agenda of any further interactions with the Mexican authorities, the violations such as mentioned above and the full implementation of the international conventions and treaties adopted and ratified by the Mexican Government[1].
  6. We demand the unconditional respect of all rights as indigenous peoples, particularly the rights to self-determination, sovereignty of our lands and territories, the free management of our environment, housing, social-, cultural- and spiritual traditions.

We want to live in peace, justice and dignity for all peoples and in perfect harmony with nature.

They seek to impose the construction of highways at all costs under the guise of so “called” legal, authoritarian and violent strategies. They commit ecocide and ethnocide against the Otomi people, affecting communities as Xochicuauhtla. Their sole purpose is to benefit a monopolistic political and economic mafia, linked to multinationals and corrupt Banks. All this flagrant violation of deliberately and systematically Mexican Law and International Law on Human Rights and Collective Rights of Indigenous Peoples. So we demand the prompt action of Organizations and International Tribunals for these bad leaders, that their illegal and illegitimate acts will not go unpunished, to be tried and punished along with its network of complicities that do not escape the action of Justice . And once again it is proved to the world that the violation of human rights are unacceptable, that there are no bad untouchables rulers and abuse of power against the people must be punished.

Girls, children, young, old, men and women of the Otomi people of the Central Region of Mexico (descendants of the Great Civilization and People Originating Tlatilca, cuicuilca, Olmec, Toltec and Teotihuacan), denounced the following facts:

During his last trip to Germany, Denmark and New York, it was once again evident before the International Community, the authoritarian and intolerant attitude of the President of Mexico Enrique Peña Nieto, of the Institutional Revolutionary Party (PRI) and the Atlacomulco Group, to pretend to hide their racism and discrimination against Otomíes heritage. It is unconcealed and his perverse and sickly heart; it is impossible to conceal his corrupt and repressive face. His project Totalitarian State and Fascista is exposed; his evil dictatorial and despotic government is unmasked. It’s ecocide and genocide plan descara against indigenous peoples. It’s network of tissue complicities of corruption and impunity shows that Peña Nieto does not represent or defend the true interests of the peoples of Mexico; he has ever done, but only due to corrupt groups and private national and transnational interests it serves and protects.

While Peña Nieto was trying to deceive the world, the government and the German people, exalting with demagogy the importance of “protecting” the ancestral cultural heritage and “respect” we deserve the indigenous peoples of Mexico, during the exhibition “The Mayas: language beauty “in Berlin, Germany; at the same time he was ordering and launching a crackdown, one ethnocidal war and ethnocide against the Otomi village in the central region of Mexico, committing outrages and attacks, trampling laws and violating human rights and indigenous deliberate acts, which constitute serious crimes and crimes against humanity. All this with the complicity of the State of Mexico Governor Eruviel Ávila, who, to nobody’s secret unconditional favor their friends, partners and privileged oligarchic and monopolistic groups of the political and business class as Juan Armando  Hinojosa Cantú, owner Group Higa, a subsidiary of Constructora Autovan.

Monday 11 April 2016, the misrule of Ávila Villegas and Peña Nieto, as part of its discriminatory and neo-colonial war, again invaded the ancestral territory of the Otomi people in the Community of Xochicuauhtla, municipality of Lerma. By surprise, as at 9 am, they ordered their repressive forces with over 1,000 riot police assigned to the State Security Commission (ESC) and the forces of action and reaction (FAR), infiltrate on three fronts: by Colonia Buenavista, by Cuauhtemoc street to position themselves in the place Lapondishi Lampeni and the place where the Peace Camp and Digna Resistance which was destroyed by the police.

With premeditation, treachery and advantage, under the protection of state terrorism, evil Federal Government and the bad government of the State of Mexico, took the opportunity to protect the introduction of bulldozers type heavy machinery with personnel from the Autovan Constructora unknown origin of Teya Group Higa, with the slogan of destroying houses, raping Mother Nature and sweeping away everything in its path, to impose a Private Highway Juan Rodolfo Cantu Hinojosa.

As an act of solidarity emergency, about 25 neighbors banded together to defend the family of Armando García Salazar, Chief Leader of the Otomi Community, in an attempt to prevent your home -a part his whole life was raided and sullied. Hitmen racist Eruviel Ávila and his boss Enrique Peña came only to fulfill the order, evict the Otomi with great violence, mostly women and children-grandmothers. The grenadiers entered the family property by forcing the plate and smashing the door with tubes and firing tear gas into the house, kicking, dragging, pushing and pulling Isabel Hernandez, traditional authority and member of the Indigenous Supreme Council, who at that time had a girl in his arms.

The bad state government intimidation and illegally just sent a guy who said his name was Luis Enrique Garcia, the area of Communications and Transport, to say the house was in a federal area expropriated and showed a copy of the expropriation decree on which he won an injunction.

This genocidal, humiliating et outrageous act that violates our inalienable, inalienable and nontransferable right to self-determination and autonomy Otomi, in clear violation of international treaties on collective rights of indigenous peoples; and the final suspension to the shelters 1123/2015 and 771/2015 which won the community that were granted on February 18, 2016 in an amparo promoted in the Fifth District Court based in the State of Mexico against Expropriation Decree 2015 of 33.5 hectares of sacred lands Otomi, by the genocide and ethnocide Enrique Peña Nieto.

The Otomi Community of Xochicuautla, is located at 2803 above sea level, supplies water to the District of Lerma and the Federal District, lives in contact with the mountain and in harmony with Mother Nature. He has been giving a heroic and dignified struggle for almost 10 years, opposing the company Autovan S.A.deC.V. Teya unknown origin of the Higa Group, against the construction of Private Naucalpan-Toluca highway, which is a snake pavement planting his death in its wake. On 17 June 2015 the company Autovan again lambasted the Otomi Community, with its water and its Sacred Forest. Despite being a protected ecological Otomi-Mexica State Park Natural Area, misrule endorsed the death of thousands of trees and the involvement of Biodiversity Mountain. The Otomi Forest is the last redoubt unimproved, the last lunge of oxygen between urban sprawl of Mexico and Toluca Valley. At that time he had already destroyed more than 12 kilometers of forest and now intended to curtail the residential area, destroying several houses at the time.

 

On April 11, 2016, the bad government sent police again to continue sowing the abuse and destruction of our land, despite the injunction granted by the Court.

 

President Enrique Peña and Governor Eruviel Ávila have no dignity, now to justify, intended to confuse public opinion by saying that his actions ecocide and genocide are completely legal, when only have dedicated themselves to threaten, divide and corrupt the representatives of the Council Real Comunales, betraying the dignity and will of the whole Community.

 

Misrule says that the expropriation of our lands and territories, the destruction of our homes and police repression are under the law, when in fact this is a crime against humanity, is abuse of power, is invasion, robbery and flagrant violation of our basic right to exist, to be, to live with Peace, Justice and Dignity.

 

These rulers claim that everything is in order, when they are using deliberate acts of racism and discrimination and are implementing a deliberate war extermination and neocolonial against our people, killing thousands of trees, hundreds of species of plants and animals, desecrating our sacred natural sites and cultural.

 

These unworthy rulers all they want is to fulfill the agreements with multinational shady and dishonest businessmen. So they want to impose this highway projects such as death. It is clear that they do not care to protect the Nature Made, the environment means or climate change. They do not care exterminate an entire people, do they care to trample the Mexican Constitution or violate international treaties on the protection and defense of the rights of Indigenous Peoples. Only show that they are arrogant, authoritarian, without morals or principles. Act as vile criminals and corrupt. Only they want to use the government machinery to enrich a few and please their friends as Juan Armando Hinojosa Cantú  of Higa Group.

 

With tactics of division and cooptation of bad government has tried to impose its rules, saying that communal land is only 884 inhabitants and not the entire community -around 2800-, indivisible and integral part of the territory of the Otomi village with tradition collective and unity. For us the land is sacred, it is life, is our mother fed us, and not be bought or sold.

 

Bad government has violated our self-determination and autonomy as indigenous peoples, and our right to free, prior and informed consultation on this project, which we disagree and we totally reject, by all the vices of consent for acts of malice, premeditation and advantage of the bad leaders and entrepreneurs Higa Group, who are presumed to have triangulated sums of money with which the bad government of the State of Mexico, with premeditation, treachery and plus- has sought to take advantage of poverty people, has deceived, bribed and pressured some local representatives to enter complicity and dcon vices of consent granting land behind the community against the will of the Otomi people, which constitutes a flagrant violation of our right to a truly free, prior and informed consultation. We do not auerdo we imposed projects affect us, we defend our right to autonomy and self-determination as a people.

  

This genocidal, humiliating outrageous act that violates our inalienable, inalienable and nontransferable right to self-determination and autonomy Otomi, in clear violation of international treaties on collective rights of indigenous peoples. This action also violates the order definitively to the shelters 1123/2015 and 771/2015 against Expropriation Decree 2015 of 33.5 hectares of land sacred Otomi suspension by President Enrique Peña Nieto, who won the community orders that were granted on February 18, 2016 in an amparo promoted in the Fifth District Court of the State of Mexico.

 

We demand justice! The responsible for these crimes must be judged, they must pay for every abuse of power, every affront, for each of the crimes committed by the evil President Enrique Peña Nieto and evil Governor of the State of Mexico Eruviel Ávila , against Mother Nature, against the Otomi people and against humanity. They will pay for each of the crimes committed, for every flagrant act of barbarism which are directly responsible. Every house destroyed by police brutality and exterminators bulldozers, every butchered land and severed with alleged impunity for corrupt, every racist and discriminatory expropriation, each uprooted plant, every polluted river, every dead spring, each tree cut down and killed, every place and corner our Forest Sacred desecrated, every child traumatized by the acts of terror of these evil gobernanes, every grandmother and grandfather assaulted, every young man and denigrated women and humiliated, each of our rights trampled upon and violated, constuyen acts of ecocide and genocide must be punished by the courts and by the entire international community.

 

Therefore we send this SOS from the Otomi-Toltec-Olmec-Teotihuacan People, asking for urgent solidarity and support to the entire international community. Honestos of all governments, democratic and progressive; Conscious Peoples of the World; all Indigenous Nations of the Four Directions:

We demand the immediate intervention of the United Nations Organization, to all national and international bodies to stop the police occupation and invasion of our, high state of siege, harassment, war of extermination, ecocide, genocide and crimes sacred territories against humanity committed by the Mexican government against our Otomi people and their communities as San Francisco Xochicuauhtla, municipality of Lerma, State of Mexico.

We urge the United Nations and the Mexican government, the immediate application of international and national legislation on the Rights of Indigenous Peoples respect for our inalienable and indispensable to our Self-Determination as Peoples Law (under the law international) and as an expression of this territorial, administrative autonomy, our right to free, prior and informed consultation on any project on our lands and territories. We defend our inalienable right as Indigenous Peoples to decide our own path and historical destiny.

 

  1. We demand the Mexican government, the final, immediate and unconditional cancellation of the Decree of Expropriation of 33.5 Hectares Sacred Xochicuauhtla Territory, and all the Otomi people, imposed illegally and illegitimately by evil fascist and racist government of Enrique Peña Nieto and Eruviel Avila Villegas.La immediate, total and unconditional suspension of the toll highway Toluca-Naucalpan, in Xochicuauhtla Territory and all the Otomi people, by the Autovan Constructora Teya unknown origin of the Higa Group. The immediate, total and unconditional withdrawal of the police force, bulldozers and staff of the company.

 

 

  1. We demand the immediate resignation of Enrique Peña Nieto, President of Mexico and evil Eruviel Ávila. Mal Governor of Mexico, being directly responsible for ecocide and genocidal war, using state terrorism; by systematic violence, by the series environmental crimes in the Otomi Territory, for grave violations against Mother Nature, a Human Rights and Collective Rights of Indigenous Peoples, which constitute crimes against humanity committed by against the Otomi people and the Indigenous peoples of Mexico.

We demand the UN, UNESCO, ILO, OAS and the International Community to the Mexican government (executive, legislative and judicial branches of the Federal Government and the Government of the State of Mexico), precautionary measures for the implementation, full force, immediate unconditional respect and implementation of international conventions and treaties adopted and ratified by the Mexican Government as:

 

  1. a) the Universal Declaration of the Rights of Indigenous Peoples of the United Nations Organization (UN) in 2007;

 

  1. b) the American Declaration on the Rights of Indigenous Peoples of the Organization of American States (OAS) in 2006;

 

  1. c) Convention 169 on Indigenous and Tribal Peoples in Independent Countries (ILO) in 1990;

 

  1. d) Conventions, Treaties and International Agreements signed by Mexico to the UN Human Rights that protect and promote the collective rights of Indigenous Peoples;

 

  1. e) also to the National Legislation and Law of Indigenous Rights and Cultures of Concord and Pacification Commission and the Mexican Congress in 2006.

 

  1. We urge all international tribunals and organizations Protection and Defense of Human Rights and Indigenous Peoples, an immediate response and effective action to prosecute and punish all violations of human rights, ethnocide, ethnocide, state terrorism and crimes against humanity against the Otomi people and Indigenous Peoples committed by Enrique Peña Nieto (President of Mexico), Eruviel Ávila (Governor of the State of Mexico) and Juan Armando Hinojosa Cantu (owner Higa Group) and all its network of complicities involved in their criminal acts that the whole world must react now and avoid longer.

We are the first people the oldest of Mexico and the world,
Culture We are a mother with a distant past that is woven into the mists of time.
We are sacred seeds that have been sown and germinated here, from the first humanity.
We come from the clan Otomi. We are a First Nation direct descendant of great civilizations called Olmec, Toltec and Teotihuacan.
We have a collective memory and historical awareness, cultural heritage, with deep wisdom and the deep roots of the old tree, as Ahuehuete the Ocote and Maguey, Jä’mu fruit (Time) and Habu (Area) we have been planted since the beginning of time by the Great Spirit, Mahkihmu, daughters and son of Mahkita and Mahkimé, came and always guided by TataHyadi, Mahkimehoi, Domezänä, Mahki Ndähi, Mahkitsibi, Mahkidehe.

With the support of our ancestors, we were born here to be and to live. We know where we come from and where we are going.
Despite the colonial and neocolonial onslaught, invasions, wars of conquest and extermination, we suffered for the past five centuries, we, the Otomi, have managed to preserve ancient wisdom, our traditional forms of social organization, sensitivity to harmony, beauty and sacredness of the universe, love and respect for Mother Earth and all living beings.
We know that everything is connected, everything that happens to plants People, animals, minerals affects the world of spirits of nature, our ancestors and of course, affects all our daughters and our son, our children, until ‘seven generations after us, affects our families, clans, communities, regions, affects our unity and our existence as a people.

Attentive and concerned by recent events, we denounce the acts of ethnocide and ecocide bad leaders who exercise a neo-colonial power .As all their predecessors colonial groups, political and economic, they put once again our Otomi people in a situation which threatens the integrity of our lands and territories, our ethnic and social cohesion, they trample the dignity of our families and communities, they jeopardize our tangible and intangible culture, the ancestral spirituality and vision of the cosmic world. Our survival, our present and our future as a people are in danger.

How do they make this ethnocide, genocide and crimes against humanity?
Like their ancestors Conquistadors, who thought all they saw was theirs, who wanted to possess, conquer and invade our territory, they continue to do so, they steal, expropriate the Earth, with deception, with perverse laws for illegitimate and unjust interests.
Mexican laws are racist, discriminatory, they are made to justify the dispossession and impunity. They were created to reduce and limit the full enjoyment and respect for our rights.

Monday, April 11 2016, the Mexican Government, represented by Enrique Peña Nieto, President of the Republic, and Eruviel Avila Villegas, Governor of the State of Mexico, sent 600 armed policemen to protect the entrance of bulldozers in the Otomi community Xochicuauhtla for the construction of a new highway. This is a continuation of actions that constitute a crime against humanity, started by the Conquistadors there are already five centuries, and continue lately with the political and economic groups, controlled by the Institutional Revolutionary Party (PRI) and the Atlacomulco group. These two represent and protect the interests of the elite and the economic interests of multinationals. In this particular case, the President of the Republic and the Governor impose this project by force and violence. This benefits the industrial construction and friends as Juan Armando Hinojosa Cantu, owner Higa Group, recently involved in the global tax evasion scandal of “Panama papers.”

Xochicuauhtla the community and the people of the community Otomi mountains, high plateaus of the valley of Toluca, and communities along the great river Lerma resist for forty years to avoid the destruction of their ancestral territory, their sacred sites and a chain of mountains that feeds the rivers constituting their source of drinking water for consumption and irrigation.

Already in the fifties, the government created without consultation and without our agreement, hundreds of wells to extract water for the needs of large cities. This caused the draining of lands, where a worrying decline in the fertility of our soil that threatens our food sovereignty. Now the water is between 20 and 400 meters deep. Lately, we have seen the many sources drying up and many rivers are now dried up, except during the rainy season.
Furthermore, the warm waters of the cooling systems of our baths were installed in order to send water to major cities for domestic use.

The government has done everything to control the water resources of our territory, previously managed with care by our communities to impose the purchase of water, a natural resource of free and open access. Those who do not have the financial means are deprived of water. The government commits a slow, insidious genocide which reduces the ability of our people to exercise their self-determination and that separates us from nature, natural harmony and sacred bond between our people, our Mother Earth and the four elements as vital water.

The grip of the capitalist system, promoted by the government, starting with the diversion of natural water resources for large industries, for the sale of water to households, then continues with the sale of bottled water, to sweetened beverages (Coca Cola, Pepsicola …), which led, among the Otomi people and throughout Mexico, the emergence of public health problems as serious as diabetes.

The peasants saw themselves proposed government list of their land to receive grants and financial compensation in case of loss of crops. In consideration of this administrative procedure, the government required that farmers purchase and use of chemical fertilizers, pesticides and genetically modified seeds. On the one hand the increase of agricultural inputs and declining crop prices, on the other hand the decrease in soil fertility, caused an impoverishment of farmers, who desert their lands.

The genocide caused by this system, said progress, manifested through the obligation by people buying food products from industry, lower quality and even unhealthy because of “empty calories”, the presence of pollutants and chemical food additives, this for the sole benefit of large agri-food groups such as Nestlé, Bimbo, Maseca, McDonalds … All this causes the deterioration of health with the onset of obesity, malnutrition, cancer, other diseases of civilization and premature mortality.

The Otomi people have experienced the loss of a huge territory from the invasion of the Conquistadors and, in the vicinity of Mexico City, he now suffers from the expansion of cities and projects imposed by the government, always for the benefit of richer. So he lived forced expropriation, he was driven from his land for the establishment of industrial zones, commercial and urban. Such is the case of Toluca-Lerma Industrial Park where it is located hundreds of companies and many multinational companies, the complex “Fraccionamento” and the field of golf club Los Encinos oligarchy and subdivisions as Fraccionamento Las Trojes to Temoaya, by the river. This development has taken agricultural land and the government accepted the creation of two wells, which has dried up our fields. Now is the threat to impose a new housing project in the grounds of the former Rancho El Cordero, also Temoaya, knowing that it will cause water shortages for our communities, a new pollution and the increased crime and insecurity.

For decades, these industries discharge their toxic effluent into our sacred river Dathe Rio Lerma who now is completely poisoned, this ecocide and continues every day with impunity by the corrupt government.

The Otomi have become simple workers with low wages to enrich the bosses who have despoiled. Their ancestral land, which was a living earth, is now an urbanized land, polluted and dead, when our people trying to survive while resisting assimilation and extermination.

The construction of the Toluca International Airport caused the breakup of our communities, and now, families are uprooted, separated and isolated in small apartments. This loss of our territory entails the alteration of the conditions and ways of life of our communities. Their cultural and spiritual identity disintegrates and it follows an irrecoverable loss of diversity, richness of civilizations and ancestral Aboriginal cultures, which constitute the common heritage of mankind.

Lately, conflict between our communities and the government have taken on a new dimension because of the lack of water and traditional food, healthy and local. It is unacceptable that the authorities cause such degradation of our living conditions and lead to a shortage of water and local food resources, so that our earth is a living earth, fertile and generous.

Each square meter of land ravaged, each new tree, every pine, cedar each, every tree, cut or grubbed adds to the loss of millions of others, it affects the natural balance of ecosystems, biodiversity, all forms of life and the harmonious and vital relationship of our people with the mineral, vegetable, animal and Nature Spirits.
Each source or river, dried up or polluted, is an affront to all living beings and causes an insidious genocide. These seventy years, riparian communities have contracted diseases and epidemics related to river pollution. Many plant and animal species have disappeared, and many people died.

The Mexican government and the State of Mexico are directly responsible for this situation where, only in the valley of Toluca, 5 million people, and in the Valley of Mexico almost 35 million people are exposed every day, and more , these deadly risks. Pollution of water, soil, air affects the health of millions of people who find themselves weakened, patients with serious and fatal lung and digestive diseases.

Genocide and ecocide against the Otomi people are manifested through projects such as artificial communication channels (highways, airport …), dams, industrial and commercial zones and urbanization zones. These economic development projects are a form of retribution politicians to industry groups who supported them, which is a form of corruption. Under the pretext of progress under the pretext of land use such as improving communication channels, the government commits whenever genocide and ecocide when expelled our communities and families from their ancestral land which is devastated afterwards. This uprooting led to the irreparable loss of our livelihoods, our independence, our identity, our dignity. The realization of these projects affect the self-determination of our peoples and violates fundamental human rights and indigenous peoples.

All this is the consequence of an oligarchic authoritarian, neo-colonialism that seeks to impose a world order in which money, lies, corruption, forced passage and violence are the foundation.
Modernity, progress, excessive industrialization, technology in all its power by the means and the alibi. This modernity is presented as the absolute model of progress, and money is the first and only value. Our Otomi People undergoing this neo-colonial economy and neoliberal model that supports the Mexican government imposes and that leads to genocide and ecocide. The agreements, signed and implemented without any prior consultation, as was the case for NAFTA (the Free Trade Agreement of North American signed between Canada, USA and Mexico) and the free trade agreement TPP (Trans-Pacific Partnership; PTP french Trans-Pacific Partnership) benefit only to multinationals, banks and the Mexican and global oligarchy.

The President of the Republic and the Governor of the State of Mexico simply deny the principle of Free Prior Informed Consent and Enlightened. Yet it is now widely accepted that indigenous peoples must be consulted when development activities may affect their rights and they must have the ability to grant or withhold their free, prior and informed consent to the realization of activities taking place on the land or having an impact on the resources on which they depend.

Two legal proceedings have been filed by the Otomi people and the court decided to stop the motorway works and the temporary suspension of the order to expropriate 36 hectares of inhabited land, farm and wild, which has not respected: President and Governor decided to go into force. It is an act of denial of justice, an act of terrorism of state and government, with the sole intention of serving the financial and economic interests of their friends Higa group.

As the President of Mexico, Germany, inaugurated an exhibition of Mayan Culture and praised the greatness of the native civilizations, he gave the Governor the authority that would allow to raze the houses of Otomi, destroy sacred sites, shrines and a church, and to continue the work of the highway. 600 armed police came to deter and prevent any opposition that could enter the bulldozers and workers. If the Xochicuauhtla community had not responded massively with the help of other communities and organizations defending the rights of the Otomi people, the sacred and the church were destroyed. By against the houses, still containing all the affairs of their inhabitants, were razed.

– Convention 169 concerning Indigenous and Tribal Peoples of the Organization
International Labour including Part II on land;

Article 8d.

After this state of overwhelming places and examples of flagrant violation of the rights of the Otomi people, we demand the immediate intervention of the United Nations and the International Court of Justice in The Hague for Enrique Peña Nieto, President of the Republic and Eruviel Avila Villegas, Governor of the State of Mexico are tried for crimes against humanity, namely ecocide and genocide against the people Otomi, and also for the violation of human rights, rights indigenous peoples and nature that is contained in the declarations, conventions and agreement mentioned above.

We demand the annulment of the decree of expropriation of our lands from the hand of Enrique Peña Nieto, as well as the immediate and permanent discontinuation of the highway construction project on the territory Xochicuauhtla Otomi and other Otomi communities.

We demand the unconditional respect of all our rights as indigenous people, including the rights to self-determination, sovereignty and independence of our lands and territories, free management of our environment, housing, social, cultural and spiritual.

We demand the end of this war of extermination insidious in the name of so-called progress and economic development, the end of terrorism the Government of Mexico and the State of Mexico, the end of all forms of discrimination, racism and violence against our communities.

We want to live in peace, justice and dignity for all peoples, and in perfect harmony with nature.
